We, the descendants of the colonists, who boarded the sleeper ship “Rheinland” that arrived in the Sirius sector, who refused to acknowledge the unification of House Rheinland under sole Imperial rule, who took arms against the despotism of the Rheinland Empire and sought refuge in the Munich star system, who believe the liberty to be the ultimate value upon which the Houses of Sirius ought to be structured, grateful for our predecessors for their struggle for liberty and independence, seeking greater prosperity aligned with the spirit of our values, in order to protect our freedom from the tyranny of both the elites and the masses, proclaiming that the sovereign power should lie within those ready to serve and protect their house with their very lives, establish the state of Munich Constitutional Republic, as a part of the Federal Republic of Rheinland and her successor states.
Chapter 1: Constitutional Principles & Standards
Article 1:
The Munich Constitutional Republic is a state of Rheinland for her citizens and those inside of her borders, based around the values of her colony and the sirius-wide principles of liberty, human rights and rules of law.
Article 2:
Sovereignty lies in all nationals who exercised their commitment to the state and served in the armed forces of the state, under honorable service and for a minimal term set by law. No organization, group or individual may usurp the sovereignty from citizens and their freely expressed will.
Article 3:
The conditions necessary to be a Munich national is and will be determined and set by law.
Article 4:
The people, nationals and citizens, shall not be prevented from exercising fundamental human rights. These rights, granted by this Constitution, are inviolable and eternally protected for now and till the end of time.
Article 5:
The people, nationals and citizens, shall be respected as individuals. Their rights to life and liberty, to the extent where it does not violate or interfere with public welfare, will be always in consideration of all governmental matters and legalistrative actions.
Article 6:
Foreign nationals in the territorial borders of the Munich Constitutional Republic shall have all rights guaranteed by this constitution except those rights that are guaranteed only to citizens of the Munich Constitutional Republic.
Article 7:
The people shall not be discriminated between race or sex.
Article 8:
The freedoms and rights given to the people by this Constitution is maintained by the people who refrain from abusing these rights and serve the public.
Article 9:
The Munich Constitutional Republic shall protect the rights of her people and citizens and their interests both internally and abroad.
Article 10:
The right of existence to political parties lies only to those who are citizens of the Munich Constitutional Republic. Parties with activities that aim to overthrow this constitution, violate protected human rights or incite disruption of public peace shall be prohibited.
Article 11:
No persons shall be held or enslaved in any fashion against their will.
Article 12:
The people are guaranteed the right of religion but no religious organization shall be supported by the State. Religions with activities that aim to overthrow this constitution, violate protected human rights, force religious practices on unwilling individuals or incite disruption of public peace shall be prohibited.
Article 13:
The right of employment into governmental or state-related positions lies only to those who are citizens of the Munich Constitutional Republic.
Article 14:
The State gives the right of employment of non-state jobs to all persons.
All persons have the right to own and hold property, with the state having the ability to revoke if under violation of law. Property may be taken by the state if proper compensation is given to a group or individual.
Article 16:
The right of petition lies in only citizens of the Munich Constitutional Republic under peaceful terms. The right allows petitioning the redress of damages, for the removal of a political figure, for the enactment, repeal or amendment of laws, regulations and other matters.
Article 17:
All persons may sue for redress as provided by law from the State, public organization or company, in the case of damage from illegal actions from a public official.
Article 18:
No person shall be held criminally liable for an act which was lawful at the time it was committed, or of which he has been acquitted, nor shall he be placed in double jeopardy.
Article 19:
Any person, who is acquitted of their charges, may sue the State for redress as provided by the law.
Article 20:
The Judicial power lies in the Munich courts who solely follow the constitution and the laws of the state for all decisions.
Article 21:
The Judicial system may declare laws set by the greater Rheinland legal system, that violate the rights and laws of the Munich Constitutional Republic, to be unconstitutional and to be sent to the higher Rheinland courts.
Article 22:
Judges shall not be removed except by impeachment unless judicially declared mentally or physically incompetent to perform official duties.
Article 23:
Judges shall be protected against disciplinary action administered by any executive organ or agency.
Article 24:
The appointment of Judges occurs under review and agreement by a majority of the legislative and executive sections of government. Judges must already be a citizen of the Munich Constitutional Republic prior to appointment.
The power of the Executive lies under the position of President, a position available to citizens and elected by citizens for appointment every five years.
Article 26:
The President has the power to choose a cabinet of advisors and Secretaries of State, set by law, to facilitate the day-to-day actions of their duties.
Article 27:
If the position of President is vacant then an emergency election shall be called immediately on notification to the legislative branch.
Article 28:
The President has the right, at any time, to revoke any position in the Executive branch.
Article 29:
The President has the right, under agreement by the Admiralty, to decide the national foreign policy.
Article 30:
The President has the duty to authorize and decide on the financial budget of the State, ensuring the best for the nation and the rights of the people.
The power of the Legislative branch lies in the Munich House, the law making organ in the State.
Article 32:
Elected members of the Munich House shall be voted in by citizens who are the representatives of their voters, serving for two years per term.
Article 33:
The number of members in the Munich House and the districts in systems shall be set by law.
Article 34:
The qualifications of the representatives are set by law, other than requiring the individual to be a citizen who has served the state.
Article 35:
No representative may be serving in another branch of the State during their term, nor serving in higher Rheinland government.
Article 36:
Vacancies in the Munich House shall be filled by an emergency election in the cases of death or inability to serve.
Article 37:
Any member of the Munich House may propose a bill, the bill will be passed by the House once reached by majority by the members. The bill will head to the Executive branch for final conformation.
Article 38:
Amendments of the Constitution require the majority of the Munich House, the approval of the Executive branch and the approval of the Admiralty.
