A destroyer is a type of cruiser (and is also bigger than a gunboat), so yes using a Destroyer to pirate is against the rules.

Fully support the idea that you don't have to watch contraband sail by your base and do nothing.

The problem is, WHO decides what is contraband for these pirates. They can easily claim anything is contraband..
Much like how passengers got turned into contraband for the corsairs.... Mind you this example sorta makes sense.
