Well technically you give them one warning outside the zone if they are in the zone or alaska its KoS.
And mb52, if someone attacks you first you can kill them regardless of level.

Actually, the self defense clause only counts for level 30s if they drain your shields 50%, not really going to happen unless you are a LPI. So in most cases you can never attack an under 30.

OK new plan. To all qualified LN and LSF pilots. When notified that there has been an underlevel encroachment in the area we do not talk about, grab one LPI recruit and blindfold him and place his or her craft on remote pilot and take them into that area to use as bait. If LPI craft is destroyed, pick up escape pod and return to manhatten after you have had an accidental discharge of your own uber weapons. If you return to Manhatten with an extra pod, just say you picked it by the trade lane.:yahoo::yahoo:
