Do you beat your wife often?

Yes (well of course no one will say this)
No (Then you get asked; You beat your wife?!)

The choice is there. It has been used.

I am just asking what you think of when a punishment should be administered, nothing else.

I do not have the option to jump at someone with a surprise question because they answered "incorrectly" in this thread.

Well of course.
In general, people should be considered innocent until proven guilty. There's no doubt about that, and I'm sure everyone else agrees.
I look forward to seeing what this is really about.

I don't know what the real question is, but if it's something about sanctions, aren't they already done only if the evidence is incontrovertible?

You would need evidence to punish someone, how can you punish someone of something that can not be proven they did.

if it applies to disco - the question should rather be...

guilty after a one sided description of an incident - or only guilty after both sides had their say.

other than that - guilty before proven is what we do daily on the forum ( trials by forum, labelling groups of players and spreading rumor )
