You may not fire on -ANY- transport, unless within Zone 21 or Alaska, pirating or not.
Someone got sanctioned for blowing up a pirate transport, for pirating someone, using a carrier.

And I think what you mean is finding a valid RP excuse to leave the smuggler alone? Just say your not allowed to fire at transports like that, it's a waste of energy or something.
