Yes, you need express permission from the 101st to use the Inferno, if you wish to use it on a non-Outcast character.
However, please note that it's mostly something done by allied factions. Random freelancers and mercs, even if they do help us somewhat often, will find getting their hands on an Inferno even harder than getting a set of Krakens.
