apparently mercs don't have to role play, they can buy all their guns off of another player who no doubt got them totally illegitimately.

Well, I've a BoWEx tagged Merc (I may change that tag soon, possibly for BMM or similar), with a Manta, with BHG, Civilian and BAF guns.
We're not all scum, this fellow is quite the classy professional.;)

thats the point - if you find an official faction to employ you.....i wouldn t blame you for it. actually, in RP, its not impossible to gain all that - even without a wildly invented story about theft and found things floating in space or such.

The problem is lawfuls paying mercenaries with unlawful equipment.
Realistically, what Navy officer would pay a person in an unlawful ship, with unlawful weapons? He would tell him to leave the system, because his ship is suspicious (could be a spy).

For example, I have a mercenary right now. My choice of IMG gunboat probably wasn't the best, but I managed to RP its purchase.
If you've been reading the events lately, you might see my event. I'm rping the theft of a Bounty Hunter bomber.

Well, I'm RPing the purchase of it.
It won't be having Krakens or infernos on it, nothing unlawful.
Plain Buckshots, Debs and Supernova. Maybe a mini razor or codenames, but definately not straight away.
So in essence, I will be piloting a lawful ship. But it is not optimised for pvp, it represents a prized ship from Sheffield Station. The unfortunate owner of the ship will be very annoyed that it has been taken by a ex-Bounty Hunter.
