Maltese Criminal Law Code
Indroduction
The following is a complete copy of Maltese Law's and regulations that govern the realm of Malta. It is presented here for the Public, as well as being recorded and added for the University Archives and for the University legal department's Library. It is not to be altered in anyway unless such laws are being updated.
These records are to be used as examples in legal reviews regarding Malta, references for legal documentation and for students wishing to review them.
National Council of Malta Constitution of Territorial and Interstellar Laws
The National Council of Malta, as its ruling body, has imposed this Constitution of Laws within its owned interstellar territories and bodies and expects all entities traversing its ruling area to adhere to these rules and regulations at all times.
Those who do not follow the declaration of territorial and interstellar laws emplaced by the National Council of Malta may face punishment which shall range from fines, over arrest and detention up unto summary execution by National Council representatives or their allies. The National Council of Malta reserves the right to alter the Constitution of Territorial and Interstellar Laws at any point without prior notice and the punishments imposed on offenders may vary depending on the severity of their transgression on the discretion of the representatives of the Council of the National Council of Malta, i.e. the current President Christina Martelli as well as the other councilmen if any. Orders given from a National Council representative supersede those which were issued by entities not directly representing the National Council of Malta.
The systems defined as owned and ruling territories of the National Council of Malta are as follows:
• Maltese owned space: Omicron Alpha, Beta and Tau, 85 and 92.
• And her Zone of Interest: Sigma-19, Tau-37 and Tau-23.
The constitution is also enforced in zones of interest listed as:
• All other Omicron Systems, Okinawa, Nagano (Midori Cloud), Orkney, Lorraine, Tau-31, Sigma-13, Sigma-17, Tau-29, Coronado, Cortez, and Magellan.
Extensions and restrictions of the enforcement of the Constitutions within Maltese owned space and her Zone of Interest may apply in accordance with agreements and treaties signed with and by other organizations and include:
§1; All organizations defined below are treated by the National Council of Malta as each sub-section declares.
§1.1; The following organizations, entities and their representatives are classed as allies of the National Council of Malta and have permission and agreements to access territorial installations and planets in unrestricted zones owned by the National Council. • Other Maltese families or Organizations • The Golden Chrysanthemums • Liberty Rogues • Lane Hackers • Honored individuals
§1.2; The following organizations, entities and their representatives are classed as friendly or accepted by the National Council of Malta and have permission to access territories, installations and planets in unrestricted zones owned by the National Council. • Cardamine suppliers • Ingenuus Research Group • Junker Marauders • Kingdom of Bretonia • Oracles of Ishmael • Registered contractors
§1.3; The following organizations, entities and their representatives are classed as neutral and are treated indifferently by the National Council of Malta. Some may require permission to access territories, installations and planets in unrestricted zones owned by the National Council, but they are not barred from passage. §1.4; The following organizations, entities and their representatives are unfriendly and unwelcome by the National Council of Malta and are denied access to territories, installations and planets in all zones owned by the National Council. • Blood Dragons • Gaians • Unioners • Red Hessians • Temporary Autonomous Zoners
§1.5; The following organizations, entities and their representatives are classed as hostile by the National Council of Malta and are denied access to territories, installations and planets in all zones owned and within interest by the National Council and are to be treated with caution. • Bounty Hunters Guild • The Core • Farmers Alliance • The Gallic Council • Hellfire Legion • Hogosha • Independent Miners Guild • Kusari Exiles • Republic of Kusari • Republic of Liberty • Republic of Rheinland • Sirius Coalition • Xenos • Battlegroup Auxesia • Bundschuh • Listed criminals
§1.6; The following organizations, entities and their representatives have an official declaration of war by the National Council of Malta and are to be killed on sight in all declared territories and zones of interest. • Corsairs • Colonial Republic • Gas Miners Guild • Kingdom of Gallia • The Order • Cryer Pharmaceuticals • Listed terrorists
Section 2: Crimes and actions of hostile intent
§2; Within respective territories of the National Council of Malta and its areas of interest, this subsection designates any actions that can be treated as crimes or hostile actions against Malta and its ruling Council.
§2.1; At any point, final judgement from the National Council of Malta can come to anyone attempting to circumvent, loophole or obstruct the Constitution of Territorial and Interstellar Laws and punishment may change on the discretion of the current members of the Council of the National Council of Malta.
§2.2; Denying orders or punishment imposed by the National Council or any Maltese individual may result in judgement of higher fines, arrest or even summary execution.
§2.3; Instigating or direct violence, piracy or hostilities against individuals or representatives of the National Council of Malta, parties of §1.1 and §1.2 can result in arrest.
§2.4; Any IFF (Indication Friendly or Foe) or Identification papers that ships and/or their pilots display and belong to those that fall under §1.5 or §1.6 may be subject to a fine or summary execution for inciting terror or a unneeded military response, even if the person affiliates with a neutral party.
§2.5; Entering restricted zones is punishable by immediate destruction of the offending vessel and the confiscation of black box flight recorders.
§2.5.1; Restricted zones are listed as: • The graveyard surrounding the Unstable jumphole within the Siniestre Cloud • A 10K security zone around the Omicron-85 jump hole. • The Omicron-85 system and all of its interstellar bodies. • The Omicron-92 system and all of its interstellar bodies. • Ships allowed to enter restricted space
§2.6; Foreign Warships are classed as Capital class and Gunship class who enter Maltese owned space. Those entering without permission may be subject to immediate destruction if they do not divert their course out of both Maltese owned space and the Zones of Interest.
§2.6.1; Exceptions for Foreign warships within §2.6 are as follows; • Allies of the National Council of Malta may only bring Gunship class vessels within the Owned territories, while capital ship classes will be allowed within Maltese Zones of Interest. • Bretonian Warships within the Tau Regions fighting against Gallic vessels and assets. • Rheinland Warships within the Sigma-13 system bordering the Federal Republic of Rheinlands core systems. • Buro Der Marineintelligenz vessels within the Omicron and Sigma regions assisting against Corsair vessels and Assets. • Capital vessels allowed to enter
§2.7; Cases of espionage such as duplicating or disclosing restricted files, communications, or information without permission and attempting to tamper with the peace between the National Council of Malta and its allies or neutral parties is punishable by banishment or immediate execution.
§2.8; Any undue, disrespectful and hostile interactions with the Nomads within Maltese owned space and her Zone of Influence are forbidden any may result in eviction of Malta’s owned space and her Zone of Interest or even summary execution.
Section 3: Regulations of trade, equipment and materials
§3; Subsections define what is stated as the regulations of trade, equipment and materials within National Council territories and its zones of interest.
§3.1; The following are declared as contraband in territories and zones of interest of the National Council of Malta and any offenders caught with said cargo will face fines from $3,000,000 USC (Universal sirius credits) with an additional $250,000 USC for every 1000 units of cargo (rounded up) and subsequently asked to relinquish said contraband to be destroyed.

§3.1.2; The following equipment from these manufactures and organizations is classed as contraband and are fully restricted to those not directly representing the National Council or its allies as defined under §1.1 and §1.2.

§3.1.3; The following ships from these manufactures and organizations is classed as contraband and are fully restricted to those not directly representing the National Council or its allies as defined under §.1.1 and §1.2.

§3.1.4; The following ships and equipment types manufactured by the following entities are prohibited in Maltese owned space and require permission from the current President of the National Council of Malta.
Any foreign capital ship classes, cruiser or above.
Ships belonging to factions listed under section §1.4, §1.5, and §1.6.
§3.1.5; Cloaking devices, Survey Modules and Jump Drives are banned within Maltese owned space. Ships not belonging to the National Council and/or its Allies using this equipment must disable and unmount this equipment to be stored in their cargo bays unless permission for their usage is given directly by the Council of the National Council of Malta.
§3.1.6; Ships using and/or assisting in the use of Survey Modules and/or Jump Drives within the Maltese owned space will be fined and possibly banned from the territories of the National Council of Malta.
§3.2; Mining in areas in Maltese owned space and Zone of Interest of the National Council of Malta is permitted to affiliates working directly for the National Council or its allies. Those not listed under §1.1 and §1.2 will need permission to mine within the below listed areas or may be taxed on every visit to avoid further punishment.
§3.2.1; These areas that fall under §3.2 include:
The Niobium and Beryllium fields within Tau-23
The Hydrocarbon field within Tau-29
The Helium-3 gas pockets within Sigma-19
§3.3; Any Nomad remains confiscated from ships not belonging to representatives of the National Council of Malta are to be handed to an authority figure of the religious community to be disposed in the graveyard in the Siniestre Cloud.
Section 4: Regulation of Installation construction and placement
§4; The following subsections regulate the construction and maintenance of modular installations within the ruling body of the National Council of Malta for Maltese families and corporations. The National Council of Malta is not responsible for any damage and/or death(s) occurring on these installations and the installation owner bears the full responsibility for assets and people under their care.
§4.1; Construction of Installations in Omicron-85 and Omicron-92 and other areas stated within §2.5.1 is strictly forbidden and installations belonging to any party other than the National Council of Malta are subject to immediate deconstruction.
§4.2; The construction of modular installations and the subsequent beginning of operations and business thereon is the prerogative of those parties listed under §1.1, §1.2, and §1.3. Any modular installations have to be discussed and approved by a member of the Council of the National Council of Malta before any plans of constructions are set in motion. A payment of 25.000.000 USC is to be handed to the National Treasury (non refundable) together with the initial request that states the purpose, location, plans of future development and the proper identities of the owners. Those individuals not falling under any of the abovementioned subsections are not allowed to construct modular installations and any attempt will result in the immediate deconstruction thereof.
§4.3; Taxation of Installations is applied to all parties except those owned directly by the National Council of Malta. Those Belonging to §1.1, §1.2 and §1.3 are subject to varied taxation which starts with a Base tax of 15,000,000 USC a month.
§4.3.1; Zoning modifiers for installations are summed to the base tax as follows:
Omicron Alpha: X3 Multiplier
Omicron Beta, Omicron Tau, Omicron Eta: X2 Multiplier
Tau-37, Tau-23, Sigma-19: X1.5 Multiplier
§4.3.2: Party modifiers for installations are added to the base tax as follows:
Parties under §1.2: Additional 5,000,000 USC
Parties under §1.3: Additional 10,000,000 USC
§4.3.3: Installation Core development levels are added to the base tax as follows:
Core 2: Additional 3,000,000 USC
Core 3: Additional 5,000,000 USC
Core 4: Additional 7,000,000 USC
Core 5: Additional 10,000,000 USC
§4.4; It is mandatory for modular installations to permit any ships bearing the callsign of the National Council of Malta unconditional access.
§4.5; Placement of installations not belonging directly by the National Council of Malta must not be within 10K of any populated planetary body, or within 5K of any other installation for safety and security.
Section 5: Laws of Religion §5; The National Council of Malta grants all individuals the right to practice their religion freely and without interference.
§5.1; The National Council of Malta has ruled that the Cult of Sirius and the Holy Faith of Tarxien are the officially recognized religions of the nation.
§5.2; The National Council of Malta accepts other religions within Maltese owned space and Zone of interest. The National Council of Malta guarantees minority religions the right to practice their form of religion without interference, discrimination and persecution from both Maltese entities and foreigners.
§5.3; The National Council of Malta has ruled that anyone enforcing religious ideals or methods upon another person without their consent is strictly forbidden and anyone attempting to forcibly browbeat or intimidate others into accepting unsolicited religious teachings shall be subject to punishments ranging from fines to exile from Maltese owned space and Zone of Interest.
§1 - General Section:
§ 1 [No crime without punishment] There cannot be a crime without punishment. Punshable is any deed that this criminal law code prescribes punishment for, or deserves such according to the healthy customs and sense of decency that keep our society cohesive. If the pernicious deed is not explicitly listed in this code, the law whose intent fits closest is to be applied analogously to it.
§ 2 [Punishments] (1) The National Council of Malta prescribes four punishments which are as follows:
Fines
Prison sentences
Exile
Ascendence
(2) Fines can encompass the entire monetary liquidity of the perpetrator. Only money can be fined.
(3) The minimal prison sentence is one month, and the maximum prison sentence is fourty years. In cases of extreme magnitude, the court can acknowledge a lifelong prison sentence as well.
(4) The exiled perpetrator is to be cast out of Maltese space, barred access to all installations, though not to be met with any further malicious means.
(5) Severe pernicious deeds such as Murder can be punished by sending the perpetrator through the unstable jumphole in the Siniestre Cloud with engine, weapons and navigational systems irrepairably disabled to be judged by the forces of nature that be.
§ 3 [Limitations of reach] (1) This criminal code only prescribes punishments for crimes committed in Omicron Tau, Alpha, Phi, Beta, Xi and Tau-37 except those against the Gift of Life, Body and Mind and Personal Liberty.
(2) When operating outside the aforementioned systems, the victim of the crime needs to own the Maltese citizenship in order for the perpetrator to be persecuted.
(3) The pernicious deed needs to have been committed at the same time the deed was put under punishment and in the territories listed under (1). Exceptions to this apply in accordance to §1.
(4) This criminal law does not differentiate whether the perpetrator, the victim, the accomplice or any other person involved into the crime or misdemeanor is family, or in any other way connected to other persons. Everyone stands in judgment for themselves.
§ 4 [Crimes and Misdemeanors] (1) Crimes are unlawfuls acts with a minimum punishment of at least one year of prison. If the crime perscribes Exile or Ascension, it is also a crime.
(2) Misdemeanors are unlawfuls acts that prescribe a prison sentence up to a year or a fine as punishment.
§ 5 [Committing by Refraining from Acting] (1) Whomsoever refrains from carrying out an act that would have served to hinder or prevent the success of the misdemeanor or crime shall be treated as though they actively acted towards the success of the crime or misdemeanor.
(2) The punishment cannot be lessened in such cases.
§ 6 [Acting on Behalf of Someone Else] (1) Whomsoever has been determined to carry out an unlawful act on behalf of someone else shall be punished as accomplice to the instigator with the mirrored punishment.
(2) Negligent acting can lead to the punishment being abstained from. This can only be the case, however, if the accomplice could not have known that they were accomplice to a crime.
§ 7 [Negligence, Premediation and Attempt] (1) Only premediated acts can be punished unless this criminal code prescribes punishment explicitly for cases of negligence.
(2) The attempt of a crime is always punishable with a punishment equal in severity to the completed, premediated act. An attempt can only be made with premediation.
§ 8 [Errors Surrounding the Circumstances of a Crime/Misdemeanor] (1) Whomsoever acts without knowledge of the circumstances surrounding a crime or misdemeanor cannot act with premediation. A punishment for negligence can still be imposed.
(2) Whomsoever assumes wrong circumstances that are part of the crime or misdemeanor that would lead to a punishment that is lower can only be punished according to it. The exemptions of §1 remain untouched.
§ 9 [Exculpatory Circumstances] (1) A perpetrator who acts without the ability to understand the wrong they committed cannot be culpable for their actions.
(2) Without culpability is also who, at the time of the pernicious deed, is suffering from a pathological affliction of the mind or idiocy.
§ 9a [Exculpatory Circumstances — Justifications] (1) Whomsoever committs a crime or misdemeanor due to the need to fend off an unlawful assault does not act unlawful. If the perpetrator unreasonably exceeds the bounds of mere defence out of fear, confusion or terror, they cannot be culpable for it.
(2) A crime or misdemeanor is not culpable if it was committed to fend of a danger for body, mind, personal liberty, or property cannot be culpable if there was no means by which the situation could have been resolved otherwise and the act was necessary to avoid the danger.
(3) Whomsoever did not complete the 12th year of life cannot act with culpability.
(3.1) Exceptions can be acknowledged by the court depending on the mental development state or the severity of the offence.
§2 - Crimes against Peace:
§ 10 [Preparation of an Offensive War] Whomsoever plans an offensive war that the Nation of Malta or any of its allies are involved in against their will shall be punished with no less than twenty years imprisonment, exile, or a lifelong prison sentence.
§ 11 [Incitement of Violence] (1) Whomsoever incites violence, where it does not matter whether an actual act of violence has been realized or not, shall be punished with no less than ten years in prison or exile.
(2) The attempt is punishable.
§ 12 [Treason against Malta] Whomsoever ventures to, under the threat of violence, coersion, or actual violence:
1. Compromise the existence of Malta, her population or its customs or
2. abolish the current leading body of the Maltese society, the National Council of Malta
shall be punished with a lifelong prison sentence.
§ 13 [Dissent against the Rule of Malta's Customs] (1) Whomsoever ventures to, under the threat of violence, coersion, or actual violence, force a Maltese citizen to accept beliefs or convictions that are not their own and have not been solicited shall be punished with a fine or a prison sentence of up to five years.
(2) The attempt is punishable.
§ 14 [Church Protection] (1) Whomsoever ventures to destroy, blemish, or in any other way physically harms houses or worship or any other property of a religious organisation shall be punished with a fine or a prison sentence of up to ten years.
(2) If the act also lead to the realisation of a pernicious deed listed in the Crimes against the Gift of Life shall receive the punishment prescribed in (1) of this paragraph in addition to the one imposed for the Crime against the Gift of Life.
(3) The attempt is punishable.
§ 15 [Publically Endorsing Enemies of Malta] Whomsoever ventures to publically endorse, exalt or justify the actions undertaken by those who wish to undo the Nation of Malta shall be subject to a fine or a prison sentence of up to three years.
§ 16 [Subterfuge for the Purposes of Sabotage] (1) Whomsoever acts to obtain information and sell, leak or in any other way make it available to enemies or merely neutral parties of Malta in order for them to inflict harm upon Malta or a person holding Maltese citizenship shall be punished with a prison sentence of not less than twenty years.
(2) The punishment must be Ascendence if the act of subterfuge had the death of a Maltese citizen as a consequence.
§ 17 [Financing, Committing or Endorsing of Terrorism] (1) Whomsoever ventures to use, endorse, finance violent acts that have the intent to cause political change within Malta and her sphere of influence shall be punished with exile.
(2) The punishment must be Ascendence if the act of subterfuge had the death of a Maltese citizen as a consequence.
§3 - Crimes against the Public Order:
§ 18 [Resisting Arrest] (1) Whomsoever has been determined by law enforcement to surrender and yield to arrest and tries to evade such using trickery, violence, coersion, seduction or any other malicious means shall be punished with a fine or a prison sentence of up to one year.
(2) The limitations of §3 apply accordingly.
§ 19 [Public Nudity and Exhibitionistic Behaviour] (1) Whomsoever enters a public place without decent clothing shall be fined.
(2) The fine can be lessened depending on the circumstances of the act.
§ 20 [Undercutting the Minimum Age for Spaceborne Travel] (1) Whomsoever pilots a spacecraft and has not completed the 21st year of life shall be fined.
(2) The fine is increased to a prison sentence of up to five years if the pilot has not completed the 28st year of life and presumes command over a ship of battleship size.
(3) The attempt is punishable.
§ 21 [Escaping Prison] Whomsoever ventures to withdraw from a lawful penitentiary shall be exiled.
§ 22 [Corrupting the Youth] (1) Whomsoever ventures to impose unsolicited beliefs and opinions upon persons who have not yet completed the 21st year of life shall be punished with a fine or a prison sentence of up to five years.
(2) Any damages that might have resulted out of such an indoctrination is to be paid by the perpetrator.
(3) The attempt is punishable.
§ 23 [Destruction of Evidence] (1) Whomsoever destroys, steals, undercuts or in any other way withdraws material that has relevance for the investigation of an unlawful act shall be punished with a prison sentence of up to three years.
(2) This also applies if the material in question is owned by someone and not public property. Private property is not superseding the pursuit of justice.
(3) The attempt is punishable.
§ 24 [Disturbing the Public Order] (1) Whomsoever initiates a disturbance that is not merely negligible and either reaches noise levels that are not bearable, violating the good customs and decency, or in any other way worthy of contempt shall be punished by a fine or a prison sentence of up to five years.
(2) The participation in such a disturbance can also lead to being punished according to the above.
(3) The attempt is punishable.
§ 24a [Defiling the Graveyard in the Siniestre Cloud] Whomsoever destroys, loots, or in any other way disturbs the peace of the deceased in the Siniestre Cloud shall be punished with a prison sentence of up to one year or with a fine.
§ 24b [Construction of Illicit Modular Installations] Whomsoever ventures to constuct a modular installation that has not been approved beforehand by the National Council of Malta or one of its member organs shall be subject to a fine.
§ 24c [Possession of Illicit Goods] Whomsoever transports, deals, receives or in any other way is found with contraband defined under § 3.1 of the common laws shall be subject to a fine or exile.
§4 - Crimes against Honor:
§ 25 [Insults] The insult is punished with a prison sentence of up to one year or with a fine. If the insult has been delivered using an unlawful assault, the prison sentence is up to two years or a fine.
§ 26 [Defamation] Whomsoever claims or spreads, in regards to another person, a fact or happenstance that is aimed at making them seem contemptible or to devalue them in the public eye shall be punished with a prison sentence of up to one year or a fine unless the fact or happenstance is proven to be true. If the defamation was committed using a public announcement or print, the prison sentence shall be up to three years.
§ 27 [Slander] Whomsoever, against their better judgement, in regards to another person, claims or spreads an untrue fact or happenstance that is aimed at making them seem contemptible or to devalue them in the public eye or to reduce their credibility shall be punished with a prison sentence of of up to two years or a fine. If the act occurred publically in a gathering or through distribution of print, the prison sentence shall be up to five years.
§ 28 [Denigration of the Deceased] Whomsoever denignates the memory of a deceased person shall be punished by a prison sentence of up to two years or a fine.
§5 - Crimes against the Gift of Life:
§ 29 [Murder] (1) The murderer is sentenced to Ascension.
(2) A murderer is who
out of bloodlust, to satisfy sexual urges, out of avarice, or other lesser motivations
insidiously, or cruelly, or with a highly dangerous tool, or
to mask another crime or to enable it,
unlawfully kills another person.
§ 30 [Manslaughter] (1) Manslaughter is the unlawful killing of another person without malice. Whomsoever kills another person without being a murderer shall be punished to a prison sentence of not less than ten years.
(2) The punishment can be a lifelong prison sentence in exceedingly severe cases.
§ 31 [Killing with Consent] (1) Whomsoever has been determined by another person to assist in their killing shall be punished with a prison sentence not exceeding ten years.
(2) The punishment can be lessened in exceedingly severe cases.
§ 32 [Aborting Pregnancies] (1) The abortion of a pregnancy, i.e. the killing of the unborn life after conception shall be punished with exile.
(2) The attempt is punishable.
§ 33 [Preventing Conception] The prevention of conception using contraceptives of any description shall be punished with a prison sentence not exceeding five years or a fine.
§ 34 [Negligent Manslaughter] The killing of a person that another person has negligently caused is punished with a prison sentence of no less than ten years.
§ 34a [Refraining from Extending Aid] Whomsoever refrains from aiding in the prevention of damage to body, mind, life or property of another Maltese citizen, even though it could have been reasonably expected of them and was not disproportionate to what could have been demanded of them according to the good customs and sense of decency, shall be fined.
§6 - Crimes against the Body and Mind:
§ 35 [Assault] (1) Whomsoever abuses or causes damage to the health of another person shall be punished with a prison sentence of up to five years or a fine.
(2) The attempt is punishable.
§ 36 [Assault II] (1) Whomsoever abuses or causes damage to the health of another person
1. using poison or any other hazardous elements,
2. with a weapon or another dangerous tool,
3. by ambushing them,
4. with another person,
shall be punished with a prison sentence of no less than one year up to ten years.
(2) The attempt is punishable.
§ 37 [Assault III] (1) If the Assault causes the victim to
1. lose eyesight on one or both eyes, hearing, the ability to articulate or to procreate,
2. lose an important limb of the body or have it crippled in a way it cannot fulfill its biological function anymore,
3. be permanently disfigured or assume a state of mental or physical infirmity,
the punishment is a prison sentence of not less than ten years.
(2) If any of the above is realized knowingly and willingly by the perpetrator, the minimum punishment is not less than a prison sentence of thirty years.
§ 38 [Acquiescence] Whomsoever agreed, on their own volition, to be subjected to physical abuse or health damage (§ 35) is not acting unlawful, provided the acquiescence does not seek to legitimize an act that bears an acute risk of death.
§ 39 [Torment] (1) Whomsoever torments or maltreats a person that has been entrusted to them for care or maliciously neglects them in order to achieve damage to their health shall be punished with a prison sentence of not less than ten years.
(2) If the person has not yet completed the 21st year of life or is not able to defend themselves due to mental or physical infirmity, the prison sentence shall be not less than twenty years.
