You could in theory make FL on any game engine regarldess of what you do to avoid copyright issues as long as you can perfectly copy the ship handling and camera behavior. Otherwise it will seem off.

C# is slower than C++, so technically as long as it's properly optimized UE4 will always be faster than Unity.

If only someone actually worked on a freelancer game in the Unity or the Unreal 4 engine, that would be nice.
