Just because a faction has access to it via a green cell permission does not mean they own it.

Agreed. However, if no one claims ownership of the right to trade it, it is essentially public domain and anyone who inRP produces it are treated as "owners" and can sell it according to their tech chart row as if they were owners in the traditional sense.
