No, The Order was originally a secret police-type organization with full authority over the government of liberty. not only did they have full access to the Magma Hammer and its production, but they probably had a hand in its creation. Infected Order agents denounced their uninfected comrades, and the uninfected ones fled (with most Order equipment somehow) past Alaska. While unauthorized, this pretty much gives Order the same right to claim the magma hammer and such as Liberty. You can argue it all you want, but this is how it is.
