So, will traders be reported/sanctioned for smuggling? will smugglers be reported/sanctioned for carrying legal goods? ponder that for a moment.

So here is your answer:

Smuggler ID grants its owner right to trade and escort traders. In addition to that, the Smuggler ID indicated good reputation within the Sirius unlawful factions, and is commonly used to carry smuggled goods to and from pirate bases.

I have noticed not first time that reading with understanding sometimes causes diverse problems..

To sum it up: trader can be sanctioned for smuggling, smuggler can't be sanctioned for trading, it's simple, and also it's rather obvious that noone will demand from a smuggler to run ONLY illegal goods whole the time.
