From what I saw in the news win 10 will be a free upgrade for 7 and higher users, even those using pirated software in an effort to bring users back into the fold

Thought pirates won't get. Whatever. People can use easily use Win 7. And don't say it eats so much resources, it doesn't.

pirates will get a legit copy. it just wont be licenced. what that means is they probably wont get all the spiffy updates later on without getting a licence.
