Arrest RP is usually done by bringing people near prison and make them log off (but it may differ on case to case and house to house basis). Of course if you meet same lawful later again (especially if it´s like twenty minutes later), it is usually RPed out that you escaped from prison and thus you are either brought back again or shot.
Fines are generally for minor crimes like smuggling or disorderly conduct. You pay and you may go (with confiscation in case of smuggling). But if you are member of organization which is declared illegal in the specific house (like Rogues in Liberty, Hessians in Rheinland, Gaians in Bretonia etc.), you are to be arrested, fines are not an option in this case. You are simply member of known criminal or terrosti organization thus you are treated as such.

LIke I already said above. If you are member of outlawed organization in that respective house, it does not matter if you are committing crime or not in the moment of encounter. You are to be arrested or neutralized because you are possible threat.
If you are member of some other unlawful organization, then usually you should not be arrested, yet treated as suspicious, so in some cases you can be asked to leave for example.
In case of Pirate ID, it gets little more tricky. Hardcore RP conduct should be to let him go unless he is known pirate or reported for piracy. But due to how easy is to obtain new identity in this game, usually they are attacked. It depends on attitude of each player.

I already described that above a little. Basically, say you surrender and then you will see what happens. But it should not mean that lawful will just shoot you, that´s not okay.

This is actually just result of lack of /arrest command and generally inability to properly roleplay courts and jails and such. Of course inRP there is reason to arrest people, because inRP people are jailed, they serve their sentence and then are released. We just can´t/don´t want to RP that. Or are you willing to wait few years before your Rogue character will leave the prison where he will end for robbery?
EDIT: Oh and after reading comments - like others already hinted, try to play more outside of Liberty. For several reasons, the amount of people who don´t RP at all or have very flat RP is the highest there. No offense intented but it´s a fact.
