I was screaming about this when the rules were being changed as well as other RM people. Because it basically means that:
I fight a pirate in Hamburg.. he flees after loosing all bats and bots.. and goes to pirate in Frankfurt...I fight him there he flees... and goes to Dresden.... and so on...

I think this is fair--retreating isn't the same as being killed.
However, re-interpreting rules every time some one gets mad is getting really confusing to the rest of us.
I have been told from day one--if you retreat, it's the same as dying.
Now that isn't the case.
