I vote for a rule amendment

Although the rules certainly can be interpreted that way, that is taking the letter of the law into account while leaving the spirit alone.

Agreed perhaps the Rule should be phrased differently to only allow the ruling faction the option of killing under levels but again it's only an observation and I think my scenerio is unlikely to ever happen so it's probably not that important.
