It's not a rule that he can't, it's just bad common sense. It's against the rules if the pirate is not getting shot at by the local law enforcement.

Now, I have pirated outside of planets (it's a pain in the butt if you're doing it correctly) and have even done it sucessfully. But it's usually very temporary. And it's usually because I was pirating on a trade lane and chased someone to the planet and am now waiting for them to launch. If someone comes along I'm not going to ignore them, I'm going to shoot them.
