I know at least one pirate gunboat who stays neutral, and has no tag, and sits near bases of lawfuls without getting shot at.

Personally I think that is against the rules,

6.2 Out of Roleplay (OORP):
In-game tag seen before the name must match the ID as closely as possible. It is not allowed to have the tag not match ID category. For example, it is prohibited to have 'Police' tag and 'Pirate' ID.

but it's not my call and the powers that be allow it.

Did you report it? Its a pretty easy thing to nab them on, if you screenshot them near an enemy base and nothing is firing at them, then they get their reps fixed at the "admin price". Make sure you get a screenshot of their ID and ship, too, sometimes tags can be a little screwy, something that will be noticed when flhook loads up their repsheet.

I can point to plenty of sanctions for that kind of behavior, the admins don't allow it, but like said before, they can't be everywhere.
