Give me the freedom to choose between talking and not talking.

The freedom is there already, as long as the rules are followed. For example:

*the approaching ship maintains radio silence and doesn't respond to hails*
*the weapon systems of the approaching ship are powering up*

A couple of messages like that, along with some time for the opponent to react to it should be enough to respect both the spirit and the letter of the rules, as long as your ID allows you to engage that target. And in a way, it may be better for RP atmosphere.
