Traders/Smugglers ignore 4Hour rule?!?!

Rather pointless a trader returning to a system awash with pirates, unless the trader spawned in that system, then may be theyd have pass the pirates to leave the system, that happened to me a few times,
I just took off empty :)cargo-hold and found the nearest JG.
Id seen many pirates returning a system after theyve been destroyed:angry:, on a few occasions had some pirates reengage in the :nono:same battle.
I get the feeling some pirates dont consider death when engaging traders as a PvP kill.
Sorry I mean Pirate / Authorities death at the hands of a trader / smuggler is counted as PvP kill?
The rule needs changing; Death should hold a much high penalty for all :cool:
