Chapter 2: Judicial

Article 15:

All persons have the right to own and hold property, with the state having the ability to revoke if under violation of law. Property may be taken by the state if proper compensation is given to a group or individual.

Article 16:

The right of petition lies in only citizens of the Munich Constitutional Republic under peaceful terms. The right allows petitioning the redress of damages, for the removal of a political figure, for the enactment, repeal or amendment of laws, regulations and other matters.

Article 17:

All persons may sue for redress as provided by law from the State, public organization or company, in the case of damage from illegal actions from a public official.

Article 18:

No person shall be held criminally liable for an act which was lawful at the time it was committed, or of which he has been acquitted, nor shall he be placed in double jeopardy.

Article 19:

Any person, who is acquitted of their charges, may sue the State for redress as provided by the law.

Article 20:

The Judicial power lies in the Munich courts who solely follow the constitution and the laws of the state for all decisions.

Article 21:

The Judicial system may declare laws set by the greater Rheinland legal system, that violate the rights and laws of the Munich Constitutional Republic, to be unconstitutional and to be sent to the higher Rheinland courts.

Article 22:
Judges shall not be removed except by impeachment unless judicially declared mentally or physically incompetent to perform official duties.

Article 23:

Judges shall be protected against disciplinary action administered by any executive organ or agency.

Article 24:

The appointment of Judges occurs under review and agreement by a majority of the legislative and executive sections of government. Judges must already be a citizen of the Munich Constitutional Republic prior to appointment.
