Dr Isabella Saito

My name is Inspector O'Sullivan of the Civil Defence Initiative. I have been assigned to lead the investigation into the incident that occurred on 24th November 834 in Leeds, involving the MFE Penicillin and several CDI constables.

Summary of fact:

Our records indicate that Special Constables Harding, Montgomery and Pickering were involved in a violent altercation with hostile vessels near Leeds orbit, resulting in an emergency ejection. The HMC Tamworth captained by Sergeant Appletree was also in attendance.

While commanding the MFE Penicillin, you rendered aid by bringing the escape pods aboard, before withdrawing to ameliorate the possibility of further attack. You then provided medical assistance to the recovered constables.

Upon regaining consciousness, special constable Pickering became agitated and refused consent for further treatment, and requested you release him from your care. You responded by directing your staff to tranquilize him.

You then commanded your vessel to withdraw from Bretonian territory, setting a course for an MFE installation in the Baffin system. Once completing the assessments you deemed necessary, the constables were transported back to Planet Sprague and released into the CDI's custody.

My findings:

Your intervention in rescuing ejected pilots during a combat scenario was laudable and something to be encouraged. Bretonian common law precedent recognises a "good Samaritan principle", which shields rescuers from liability attached to incidental injuries incurred by subjects during a good faith rescue attempt.

This is intended to encourage passing traffic to render aid in the event of disasters or emergencies, without fear of civil lawsuits for accidental injuries caused, such as tractor beam whiplash.

The United Kingdom of Bretonia Charter of Interstellar Law (UKBCIL) defines assault and kidnapping under Regulation 3.1. In particular, kidnapping is defined as the coerced detention of any vessel or individual, i.e. the holding of pilots or escape pods.

I consider your conduct in securing the ejected constables and withdrawing from the area was both reasonable and lawful, given that the HMC Tamworth was still engaged in combat and was not in a position to safely receive casualties.

I consider that withdrawing beyond Bretonian territory into Baffin was unreasonable. This is on the basis that safe locations were available for the held officer's care at LD-14 in Leeds itself, or on Planet Harris in Tau-31. The latter hosts both a fully provisioned Bretonian colony - including military triage facilities - and Cryer Pharmaceuticals medical facilities.

Finally, your approach to Constable Pickering's care was both unreasonable and potentially unlawful. Constable Pickering was cognizant of his circumstances and capable of making informed decisions about his own care. He refused consent for a procedure which you ignored. This potentially rises to the level of malpractice, and is certainly unethical.

Tranquilizing Constable Pickering and transporting him against his will to Baffin was both unreasonable and potentially unlawful, engaging the kidnapping provisions of section 3.1 of the UKBCIL.

Having reviewed the relevant patrol reports and your own testimony in this channel, I consider that the actions deemed unreasonable and potentially unlawful were not undertaken with malice. I believe they were likely motivated by a genuinely-held belief that the course of action was in Constable Pickering's best interest.

Despite this, the actions were still improper and in gross contravention of both Bretonian law and medical regulations.

My recommendation:

Having discussed this matter at length with both the Chief Inspector and the CDI's legal officers, we have determined that a suitable resolution would be to issue a formal caution to Dr Isabella Saito as the commanding officer of the MFE Penicillin, and require an apology to now-sergeant Pickering.

Currently we are not minded to issue a fine, or to refer this matter to the Crown Prosecution Service. We feel it better serves the public interest to resolve the situation without further escalation.

A caution requires the subject to acknowledge and accept the offence. It is not a criminal prosecution, but acts as a formal warning that will remain on your record for future reference.

Please let me know if you find these terms acceptable. If so, we may consider this unfortunate matter closed. Failure to accept this issued caution may result in the pursuit of alternate non-consensual enforcement means.
