I think you might be overeacting a bit, anyone who has played the game for more than a year knows how it is. As a player you always have a choise, most of the traders I have pirated chose to go silent and try to run away. It's not that hard mate, If you wanna play safe do it, otherwise roll the dices and find out.
I've been playing for over eight years, and I've rarely won a PvP. I've been pirated by five at a time, and I've literally had to suck it up on occasions where, due to my own decisions, I've gotten myself into places where I was guaranteed to get beat. That's the way it is.
All this fuss about ganking rules is not about ganking itself, but about the usual whiners who can't stand to see their pixels explode.
