I still think this is perfectly valid.
Just because people can choose to be exempt doesn't mean they should simply be ignored, and moreover, if you incorporate their ideals, you can get a system that more people will agree to participate in, thereby making a stronger council. If a council is in fact your goal, you should want it to be as inclusive as possible.
