The restriction of capital ships would not be the job of the primary fleet, but rather the high command, specifically for the reason you stated.

Order high command consists of both the Order| faction leaders, as well as several Order| -and- independent order players. This allows for an unbiased viewpoint, as all issues are voted on amongst players of both the faction and independents. That is why such restriction is more likely to work in our case, whereas for most factions there is no combined faction/indy group with authority over the rest.
