Yes but that's the thing, the group would be considered unlawful until that group won. After they won they'd be the lawfuls. Lawful or Unlawful could be dependant on who is in power at the time. You can take one of the IDs of an unlawful faction who's aim it is to topple the government but don't RP the piracy thing, work your RP in the direction you suggest. If you take a generic ID like Military and begin your campaign your group will still be considered "unlawful" to the government it's working against (or cleaning up the "key govenrments members")
In this idea you have it's going to be more on how you RP.
Example: Take Hessian ID to confront RM and RFP. Don't pirate/smuggle and don't kill civilian factions, keep your RP as revolutioanry/seperatist. You'll see that idea coming in the Gallic house. There is an "unlawful" faction that opposes the "lawfuls" and will leave the civilian factions alone (the Maquis)
