No, because the same logic could apply as follows:

Viz Admiral Dieter Schprokets is engaged while in his Cruiser, the Neustadt, and it is destroyed but he escapes in a pod unharmed. He is tracked in to planet New Berlin, gets his Wrath, and goes to hunt those bombers.

All perfectly plausible, and in RP, but against the re-engagement rule.

The intent of the amendment I proposed is to clarify that being pirated, even with no shots fired = being engaged, to improve clarity of the rules.
