Agmen 90% of the time when I encounter empty trader/trader with not so worthy cargo he says:

In my book the pirate should not ask more then the whole price of the cargo- for example you it will be abuse to take all cargo from gold miner(44mill) and ask other 5 mill for his live. Or if the cargo worth is 10 mill at the trader's destination to ask for 12 mill tax.
If the two factions are hostile then you can just demand all cargo and kill it even if you cannot haul it.
