Of course not every Military Players act like this, but this is the main interaction i have with those.
I never said House Militaries aren't that great. As you can take out of this quotation of mine, i said that the CR did a great job, however my experiences with House Militaries aren't that great as they were with the CR.
Also i added that of course not every single House Military acts like i described.
So how would you consider that an "attack"?

That is incorrect, both assumptions are. You get into pvps as much as you personally want and even if you react to situations according to faction role play, there are always alternatives for a fight, even if you get attacked.
After all, this is a role play server, role play is all about innovation and creativity.
Well that was based upon my experiences.
As pirate, you decide whenever you want to attack, or when you don't. Or you simply smuggle goods or trade with your allies.
As a military you can't rp-wise just pass a pirate that is currently robbing a trader or whatever when you are not in the mood to pvp, wishing good luck to the trader.
Also you are not able to do smuggling or trading when you get bored of pvping, since i don't guess any Military Guy would do his patrols in a Transport - in contrary to the unlawful side which has very good uses for Transports.
