What happened is the BAF were the ones losing badly, and they were willing to relinquish claim to part of Dublin, and Breen agreed to it.
Then the Council carried on the whatever.
The Dublin Protocol was a continuation and official affirmation of that, but was instantly made worthless by the dual bounties, one put on the Mollies by the BAF, the other a licisence to kill given to the Reavers.
