The Joker's an exception to a rule. Also he doesn't seem to mind getting ganked, which means he isn't out there for the killing, just the fighting, which is a different animal altogether. But you can't use him as an excuse to let random people go around gunning about for no good reason, otherwise the server devolves into Discovery of Discovery. Even if the pirate ID is abused, checks like that tend to be the only thing giving some kind of rhyme and reason to it all.
As far as not fighting in the server, I can say that I hate lag with every fiber of my being, and that fighting in this game isn't fun, especially when I run into instances of entire RHA contingents jumping through a gate, only to run into me (alone) in a gunboat, and shouting "ATTACK THE FASCIST". Nor do I find it fun when I run into pirates who demand an absurd amount of money because all they want to do is blow me up. As such whenever I play I end up hugging bases where I can dock, and battleships that fire back, because quite honestly that's the only thing preventing me from being shot to pieces for no justifiable reason every 5 minutes.
I still say merge all generic IDs, including terrorist, (but not miner or researcher) into one, and let actions -shooting/pirating/escorting depend on player RP.

Reason is simple, true pirates would never stand and fight. They would take all the cash, jewelary etc. and disappear. While we have a bunch of sitting pirates, waiting for some prick to annoy him to get a reason to go blazing weapons.
The only pirates I saw in DiscoGC were The Lane Hackers. Never did I see them fighting, nor did I saw a message of the being destroyed. Too bad. That's what? Like 5 to 10 players? Rogues. Ech. Never saw them. Server lacks true pirates. That's my opinion.
Now I don't want to make some kind of revolution, however, fixing and adding few restrictions to Pirate ID would solve the problem. Such as "Cannot engage lawfuls" or alike.
Well. I hope you get my idea. May the discussion begin, about piracy, PvPabuse and hopefully the problem itself.
EDIT: Yeah. Forgot to talk about terrorists. Well. Pirates in DiscoGC are exactly those. They want to shoot rather than make profit. That's why a generic terrorist ID letting engage lawfuls but forbidding to engage trade ships would make more sense and deeper RP immersion.

Pirates (Generic IDs) are free to expound upon their character and what his choices in life are. Some may be crazy and attack lawfuls. And what do you mean they don't attack lawfuls... what about THIS, and THIS, and THIS, and THIS, and THIS, and THIS.
POINT IS: Pirates DO attack lawfuls.... And I could find TONS more but I think my point is proven.

From the examples you've given it seems that most of them won't ever do it again. I can pull an example of US warship shooting an airliner but that doesn't imply that LN Guard ID should be allowed to destroy liners.
