Well, as Alley mentioned in another topic, the server is in france, but the owner is in US. Everybody knows that especially US has got a quite hardline law about copyrighted content.
Microsoft is not forced to answer any contact regarding copyright content as long it isn't a suit.

A: Currently haven't the users terms in mind of Freelancer in mind, but I guess it's similar to the most games. Best way is still a call instead of an email.
Without a specified declaration it will be still dangerous for the server and website owner and discovery overall.

B: A solution might be to archive any contact with microsoft and add a notification at the end of the installer, that contains "discovery's" declaration. The server and website hoster will be on a save side, but Microsoft still can stomp in between shutting disco down.

Temporary B will work, but the final way is A.

This isn't worth the risk, at all.

If you push your luck and Microsoft takes note, this server has no way of competing legally.

It's not worth it. Forget about it and be happy with what we have left.

What contact? What declaration? I don't see how anything less than an explicit "you can host the game files" will hold up in court.

Either you haven't read the posts above or you're the biggest scaredy cat i know of Tongue

there is no reason not to. without risk comes no reward after all, even tho the risk is very very little here

Well, this is a good idea. For example, my original Freelancer disc has a huge crack due to heavy use. This happened around the year 2007. Since then I can no longer read the original cd. Lucky me that in 2008 a friend copied his ISO on a blank CD and gave it to me. I've been using that copy since then.

And the risk is this server being shut down. If you don't understand that, go ahead.

Just make Discovery a stand-alone mod. Include the whole game files in the install file, you will not have to worry about MS nuking Freelancer downloading pages or any other retailers that you can't get the game from anyway.

Sounds like a reasonable idea to me.

If it caves for whatever reason and ISO's/Torrents of Freelancer become a little sparse, I could probably do something about that myself, I have an original FL CD tucked away in a safe place and I have a copy of that as well, plus I use an ISO to re-install when I need to -- it's way faster than installing from the CD!

I think we all know the reservation of the Dev Team to do that. Sadly, we know how corporations work and even if we publish the game for free with the mod - there's no guarantee that server won't be shut down, as Microsoft would simply ask the server provider to shut and erase it entirely. With no chance to reverse to the status quo. This is how lawsuits, whatever stupid and dumb they might be, work.

That's why people are not willing to include it into mod.
