It is users fault for not proper usage of the said equipment.
Cloaks are useless unless you know how to use them.
You can use a hint or two or buy used cloak and train yourself and other users of your vessels together with the users that use own used and new vessels that use to shoot you in order to learn how to use it.
Use your brain- it is useful.

Not sure, but there was talk about disallowing cloaking while being hit with weapons fire. Might have been implemented finally...
