In recognition of unified effort to ensure the safety and prosperity of the systems of the Tau Cluster, against any and all threats that would wish harm or otherwise undue burden upon those that reside, commune, or otherwise conduct beneficial business within the systems therein, the free peoples of the island of Lipari, wide in their range and regardless of their motherland, do declare, in accordance with the Articles of Succession of 382 A.S., the formation and establishment of the Liparian Republic.
Section I - Establishment
Article I - Declarations
§1 - La República Liparia, hereafter referred to as 'The Republic' or 'Lipari', shall recognize the individual's right to representation, directly or indirectly, in a congregation.
§2 - The Republic shall recognize the Rights of Man, their sacred position, inviolability, and defense.
§3 - The Republic shall recognize the individual's right to privacy, whether at home or in public, so far is it does not violate the rights of another.
§4 - The Republic shall not recognize any state religion, and shall preserve and defend the rights of all to practice any religion or philosophy so far as it does not violate the rights of another.
§5 - The Republic shall recognize the individual's right to petition, assemble, and protest, so far as it does not violate the rights of another.
§6 - The Republic shall recognize the individual's right to free movement without obstruction, including the right of the individual to safety and asylum in times of grievance, so far as it does not violate the rights of another.
§7 - The Republic shall recognize the individual's right to education, information, and learning, without bias, tamper, or falsifying of material. It shall be the Republic's duty to promote and ensure access for all to these rights, so far it does not violate the rights of another, nor threaten the security of the nation.
§8 - The Republic shall not infringe upon any of the rights of this article, unless pursuant to a law or executive statute.
§9 - It shall be the duty of the Republic to enforce, protect, defend, and maintain these rights through any manner that itself does not violate the rights outlined in this article.
Article II - Acknowledgements
§1 - Lipari shall be, and assume all responsibilities related to, the continuation of the Republica de Malta.
§2 - Lipari shall not, under any circumstances, be considered a Maltesian nation.
§3 - Lipari shall validate, authorize, and become beholden to any treaties, agreements, or other signed documentation applicable to the Republica de Malta.
Section II - Structure
Article I - The Republic
§1 - Lipari shall be a democratic and social republic.
§2 - Lipari shall derive all legal power from the people, to be exercised through elections of both the populace at large and within the appropriate legislative, executive, and judicial bodies.
§3 - It shall be the right of the people of Lipari to resist any individual or organization that should seek to abolish to measures of this document should no alternative present itself.
Article II - The Executive
§1 - The duties of the Executive shall include the enforcement of a Codex of Law, the representation of the Republic domestically and internationally, and to maintain the checks and balances between the three co-equal branches of this Republic.
§2 - The duties of the Executive shall be carried out by a President who shall serve in terms of four years, or any authorized individuals or departments beneath their authority.
§3 - The Office of the President shall not be occupied by any individual who has not been elected to the position by the majority of those from which they shall receive the authority of the powers therein, or by any who have been assigned a position within the latter's specific branch of this Republic's government.
§4 - The Office of the President shall not be occupied by any individual for any period of time longer than four terms. Should any individual occupying the Office of the President be removed, voluntarily or no, the individual that assumes the duties of the Office in their stead shall serve the remaining portion of their term, and shall have all the appropriate duties, rights, and responsibilities of the Office of President.
§5 - Any duties of the Executive carried out by individuals under the authority of the former, or as part of any Executive Department, committee, or other group otherwise deriving its authority from the Executive, shall be subject to conduct regulation by the Legislative.
§6 - The Office of the President may, at times, submit statutes providing temporary instruction for the administration as a whole; Any statute submitted may be denied by a vote of no less than two-thirds of the legislature.
Article III - The Legislative
§1 - It shall be the role and duty of the Legislature to discuss, consider, and debate collectively the issues and concerns arisen by the people to which the members of such body shall represent, and to maintain the checks and balances between the three co-equal branches of this Republic.
§2 - The Legislature shall convene amongst a Congregation, to gather at least once within any time period three months following the conclusion of any prior session.
§3 - The Legislature shall be overseen by the Vice President of the Republic, who shall be granted all the rights and privileges of any other member of the Legislature, but shall not be granted any voting power within such halls, except in cases where such a vote would prevent legislative deadlock.
§4 - It shall be the duty of the Legislature to ensure that each member abides by regulations of conduct.
§5 - It shall always be the right of the people to replace, through referendum or election, their representative within the Legislature.
§6 - It shall be the duty of the Legislature to conduct and oversee any trials involving any elected or appointed official within this Republic's government.
§7 - It shall be the right of the Legislature to determine the nation's monetary spending; The Legislature shall retain the power of the purse at all times.
Article IV - The Judicial
§1 - The duties of the Judicial shall include overseeing and confirming any legal appointment to this document or any document to which this document shall provide authority towards.
§2 - The duties of the Judicial shall be conducted only with regard to the provisions of this document.
§3 - The Judicial shall be vested in judges; it shall be exercised in the Supreme Court and in the local courts of the Republic.
§4 - The Judicial shall be independent and free from all other constitutional organs.
Section III - Defense
Article I - The Armed Forces
§1- The defense of the nation shall be conducted by an armed military force under the sole authority of the head of the Executive.
§2 - The Armed Forces shall provide for the general defense of the nation, and ensure the security of all spaces owned, claimed, controlled, and otherwise overseen by the Republic.
§3 - The Armed Forces shall not provide for foreign defense under compensation of monetary or material value. The Armed Forces shall not be a mercenary force.
§4 - The Armed Forces shall have the exclusive right to lobby for locations deemed to display strategic or tactical military advantage.
§5 - In times of war, the Armed Forces shall be prioritized over all other matters non-critical to the defense of the nation. This shall include factors relating to funding, land clearance, and material goods of military value.
Article II - Gendarmerie
§1 - The policing of the nation shall be conducted by a volunteer security force (futher, VSF) under the authority of the head of the Judicial.
§2 - It shall be the duty of the VSF to maintain societal order to the extent permitted by the measures of this document, unless authorized by a law or executive statute.
§3 - To the extent permitted by any Codex of Laws, the VSF may be utilized to provide for the enforcement of measures enacted within any such Codex of Law, or to enforce any such ruling by members of the Judiciary.
§4 - It shall never be permitted for the Republic to issue a draft with respect to the VSF.
Section IV - Amendment to this Document
§1 - This document may be amended to facilitate unprecedented societal change, and to ensure the continued function of the nation.
§2 - Any amendment proposed shall be submitted to the Legislature, and must be passed by a vote of no less than a factor of seven-tenths in favor, to then be submitted to the population at large. Should the measure pass a national referendum by an absolute majority, the amendment is adopted.
3 - The form of Republic shall not be a matter of constitutional amendment.
