Can you create an unlawful bounty hunter who does not work for a specific faction? Can he pirate?

I recommend Mercenary, because on some bounties freelancer are not listed. (at least as I saw on Liberty bounty,but well you asked unlawful). That made me to buy merc ID

yeah i think so too.

Question, would I have to fly a civilian ship as an unlawful bounty hunter.

Allowed ships: Civilian and Borderworld Fighters, Bombers, Freighters, Transports, Gunboats

I guess you can always make an RP request if you want something special

Not with the Bountyhunter ID.

Cannot ally with any unlawfuls,
Cannot participate in any unlawful actions.

And by definition, can not shoot at anyone unless they have a bounty posted on them in the bounty section of the forum. Only exception, is if they are attacked first, and their shields get drained to below 50 %.

Not quite, according to technology chart.

Differences:

Blood Dragon:
Freelancer - red
Mercenary - white

Corsairs:
Freelancer - white
Mercenary - green

Order:
Freelancer - red
Mercenary - white

Outcasts:
Freelancer - white
Mercenary - green

As we can see, Mercenary ID gives slightly bigger selection of equipment.

Yes even with Identical ID info, there is a huge difference or its made like that.
Mercenaries have better way to find a job and buy equipment.
Thats why there is so many mercenaries and little freelancers (and most of freelancers are traders)
