Depends on what you're talking about. What do you wanna use it for, & how the whole 'proprty of microsoft' thing affects your judgment about it.
For example, if you wanna use it for your bands album cover, you will probably get screwed. However, if you wanted to use it as a profile pic or print it out to use it as a poo liner for a birdcage, you're most likely in the clear.

Theoretically you have infringed copyright by reproducing their image without permission, I expect we've all done it at some time. In practice they won't chase you because you aren't seeking to make a profit from it, in fact you could argue that you are improving the chances of people buying the original game thus helping Microsoft to some much needed extra profit.
It is indeed 'copyright'ed'. If you wouldn't post the link here but the picture you would already have violated that law. Spreading them via other platforms and not via authorized can lead to trouble. So in short words: Better don't use it. It's for your own safety.
