I think all traders at some point have gotten away as the result of another trader being stopped. I know I have. I've also been the reason why another trader has gotten away so it all comes out in the wash.

The trader paid, thus shouldnt be killed.
Yet the trader that fled shouldnt be obligated to pay, since he did escape.

Once the trader pays ... he's done ... that is until that same trader comes back by the pirate at a later time. Diamond / Niobium Run comes to mind here.
Trader passes you enroute to Kyushu with Diamonds ... he gets hit by the pirate ... same trader brings Niobium to Dresden ... he gets stopped by same pirate. <-- Perfectly legal.
On the other hand ... trader enroute to Kyushu with Diamonds gets stopped by pirate in Sigma 13 ... trader pays ... same pirate stops same trader in same system just a few seconds later ... probably gonna be called abusive.
But then again ... how about a lawful that stops a pirate? This has happened to me before. I get stopped by a group of house navy/police vessels ... I comply with instructions ... navy/police vessels release me and tell me to depart the system ... I start moving to the nearest exit ... these navy/police change their minds and decide its not good for me to be left alive ... BOOM ... my ship is dust. <-- Kinda hypocritical if you ask me ... I mean really ... if we expect pirates to be civil and let the trader who pays to continue on his journey ... shouldn't we expect the same civility from the lawfuls.
To the original post: I'd say it's cut-and-dry; if the two are NOT in group, then blowing up the trader who paid is sanctionable. as a trader, I'd be extremely hard-pressed to not file a sanction report if that happened to me.

Now from being around a while, I know how Baltar feels when it comes to pirate rights...not many are as fanatical as he. But in this case you're absolutely correct Baltar. It's the same as a police officer pulling someone over for "suspicious activity". Sure, you're going to get hassled, but if you're not doing anything wrong, you are released, not thrown in jail. Same metaphor here.
I'd say (sorry ADMIN) hit the screenshot button and send off a report. but that's the cynic in me.
I suppose I too have to admit, I've been overlooked when another trader was being 'accosted' So I really don't complain much when I get snagged. It's just a part of doing biz. Would I like to be a hostage... NO. Would I cry foul if it happened, NO. I suppose we can debate it... but really... pirates do add fun to my otherwise dull runs. So I won't. Enjoy them as you would any hazzard in space. a little spice adds life!!!
My thoughts... but then I am seeing a pirate... so I'm biased.
If Im traveling in company of another Synth Foods trader and he gets away but I dont, then feel free to run the hostage bit to try and get him to return and pay. Ill play along with that every time, even if I end up as space dust.
But if the other guy is an independent the chances are slim to none that hell come back and pay; in that case I probably wouldnt be very happy about having to use an escape pod after I already paid my own way.
