Some may ask "donations for their cause" but other than that, is it wise to tax someone who provides the base you restock from?
Surely you wouldnt want to poke a smuggler in your praetorian, who is bringing food to Crete
Nor youd want to kill guys carrying engine componens/slaves/mox to malta in your sabre.
Smugglers already are ganked by law, but what about npc faction (not generic pirate ID) players?
It's not outside the rules, but it does demonstrate a poor grasp of diplomacy.

EDIT: I get hit on occasion. My favorite was the codename-stacked Praetorian with a SN/Razor combo, I had food going to Crete. I just rolled my eyes and kept going.
Depends on what they are hauling and where I'd say.
If they are hauling normal goods, they are meant to be known merely as Traders, unless it is in RP for many pirates to know of them.
If they are hauling contraband goods, they are smugglers and again it's up to the person to choose whether or not he wants to pirate them.
In the end I'd say it just comes down to what they are hauling, where they are hauling it and if you have had any past experiences with them. Personel choice really.
As long as you are carrying goods to or from a pirate base of that faction it is probably not in RP to get pirated. If their family is starving though and yadda yadda yadda I suppose it could be in RP.
An interesting question this raises for me is what about, let's say corsairs, that live among the corsairs but break corsair laws, they just haven't been caught yet. One of these people could easily do it.

your only conection with pirates (if you havent same tag) is your cargo... I think some indies can tax you in sigmas but of course not right in alpha.... also official factions shouldnt tax you so easily because its them who from RP view hold business on curent planet in their hand so you are paying them when you are buying cargo.
if you do some 'special' runs you should built up connections.
the more you are doing it the more you are safe.
if you are a known supporter to the corsairs and get pirated by a corsair: pay, call the elders - but just do some rp around it. be assured he will get some beating.
same to the opposite side.
but some random hotshots will be still around, sadly.
