Erm, OPs proposition has nothing to do with capitals being able to hunt or pirate smugglers and traders, if I'm not blind?
Under the proposed changes, you'll be able to shoot lawfull transports with a praefect... if that transport is currently hunting corsairs, for example.
Means, no more shooting stuff in front of a battleship/cruiser, with "lol you can't keel me, because you can't".
Although, proposed rule change might use better wording... and maybe a mechanism, to determine if someone is trading or not. =\
If someone decides that a transport is a good combat ship and starts using it as a combat ship, he should be viewed as if he's sitting in a combat ship. It's like shooting people with Civilian ID. (with exception that civilian ID prohibits such things, and pirate/unlawful/police/military IDs can use transports)
The bottom line with this change is the same with a gunboat.
The 5k's'll die like fish in a barrel, the 3500-4500's will have a chance, a good one depending on pilot skill, and the 3k's and under (cept teh hege, that thing is slow as a 5k) will probably be able to escape.
It's not about armor or shields, but dodging.

This really doesn't need to be changed. I have never been pirated by a transport I couldn't easily kill. Seems like people are getting upset about the over Population of pirates (again). A better fix would be to limit the amount of cargo/credits that can be demanded. Giving caps the ability to shoot down transports (and as Zelot said it wouldn't matter if it were lawful or unlawful) is just going to push for a higher population of caps flying around. I don't think anyone really wants a server full of caps all the time.
