If contracts are broken, it leaves you open to legal action. If you personally agree to a contract without coercion, it has legal weight.
I don't agree with any of this that they're doing. It's a corruption of the consumer laws designed to protect customers. That said, in a culture where you just mindlessly click yes to everything that's put in front of you, society is just asking for this sort of dick move to happen.
