when he opened fire on you and took your shields down by 50% or more - or fired when your shields were down - then you have a right to defend yourself. i m not familiar with the mining ship in terms of how much firepower it has.



anyway - if he was assisting the harvesters that can attack zoners regardless of capship or not, then he has to take the consequence for it. ( like when a lvl1 is grouped with a lvl90, and the level 90 pirates a trader, the trader is allowed to take out the level 1, too, cause they are grouped and in the same battle )



if the mining ship was not grouped with the harvester - but still opened fire within the same battle you had with the harvesters, - it should count as the exception in which you re able to defend yourself, cause the harvesters had started the battle.



if there had been time between the two battles - and your shields had been replenished enough, it would be a different battle and the mining ship would have to take your shields down by 50% by itself to count as a valid encounter to defend yourself.



so its very much up to how the situation was presented to you. - was it one battle, two battles, has the mining ship the firepower to actually work your shields down itself? has it attacked when your shields were down? etc.
