I've heard of a lot of traders fire with no warning upon dropping out of the lanes.

To answer your questions - no and no.

As a trader, I would wait a few seconds for a demand, and if none comes I would be on my way. Now, if I think I'm capable of taking the pirate out, I would demand an explanation for the lane disruption. If offered none, I would probably fire a few warning shots and be on my way.
