Didn't they start makeing a FL2? If I remember, they made quite a bit of progress before MS pulled the plug.
If you could get your hands on the stuff they finished then maybe, just maybe you could succeed, but the odds of that happening are so slim that you'd be better of making a game using only binary code.

Haven't they already said 800 times that multiplayer support won't be there? And it's not X4, it's X3:Terran Conflict, which will be out in a couple weeks.
Write a screenplay for a FL'er movie... make it really, really, good...then put your absolute best professional foot forward & give a real honest pitch to Angelfire...not just a "wouldn't it be cool if" type of thread but a real, professional screenplay.
It's a MAJOR dice roll to be sure, but if financial backing can be found for a strong enough FL'er story, then during negotiations to buy the rights to use microsoft's property, buying the source code could maybe be worked into the contract.
...even in a 'worst case' senario, there would be a freelancer screenplay that can be shopped around to other studios if nothing else.
There are a million other ways to get the game made...this is only one idea.

How much would it cost to "buy" the source code from Micro$oft?
And if we could, we could set up another donation thingy for it, and we could all pitch in. It would make thousands if you gave it a year I rekon!
If Micro$oft was smart, they would bite for sure. But they haven't shown any real intelligence since Windows XP Professional.

Probably best to have something to offer besides money...if a movie screenplay could be sold to M$, then release of the source code could be hammered out in the 'price' or something.
Vapourlynx a modeler who used to hang around Disco and then made an apearence over at Shattered Worlds, was convinced a few months back that it was possible to faithfully re-create FL in the Unreal engine and make it compatible with the existing .ini files.
Even though I dont think that would be trully possible with anything less then an army.
Its not the source code you want to buy, its the intelectual property rights. Since the engine is unique to FL that would be implied as part of the deal, and you would obtain the right to market and sell anything you wanted in relation to the FL universe.

i've heard some guy is chatting to microsoft so that they can think about making Fl again MANy ppl are dying (not dead die) and complaining about the creation of FL2.
FL2 could be one huge sucess. Igiss and dudes from lancersreactor could maybe make a plan and get the srcipts and source code by microsoft (Wich someone suggested) and help Microsoft make FL2.but the real question is can they afford it?
Microsoft most likely will never release the source code. One main reason for that is that other games will want the same. However they don't really want that.
In regards to making FL2, it would take years unfortunately. It took Digital Anvil years to make Freelancer. Imagine a group of far less experienced (No offence intended, referring to engine work etc), part-time modders with a small playerbase to work for.
All in all, pipedream for now. In the future maybe, when space games become more popular again.
