I'll see if I can find where someone said you couldn't e-kill at cruise on your way in to attack someone and then fire while still flying past at ~350, but I know it's been said.
Soverign, there was a long discussion about the use of engine kill while at cruise.
The final verdict was you could not use cruise to decrease the flight time to the target.
If both the attacker and the target are moving at the same speed then there is no violation.
If the target is not moving over 200 then cruise torping is illegal.
Following this I would view the returning to formation tactic to gain a speed advantage would be illegal as it gives you an additional 70m/s boost to your weapon fire as well as being able to close distance when you should not be. Catching up to your teammate and waiting until your speed matches then engine killing would not be illegal, E-killing before matching speed would be.
This is very close to using cruise speed accelleration against a target that is moving at full thruster, thus yes, it would be a violation.
Ok so there i was just found myself jumping from Alaska>NY with a load of cardamine!! Start my cruise engines and head for the minefield field. Success i made it and have 1 contact @ 14K!!, I jump on the lowed speaker and tell the crew to get to there posts we are making a run for it. By the time all is said and done i dive under the system star they give chase at this point i look at my radar to see that I'm now 2k ahead, mind you Mr.Policeman's wing man joined the chase. Incoming missile!! my HUD starts flashing red like brothel after midnight, as i think to myself thats it I'm done for then out the starboard side window i see direct hit!! Much to my surprise i am still in cruise/warp I sit back in my chair and let out a long sigh of re leaf turn and look to my XO and said wow we got lucky they were only packing a Fighter cruise disrupter its no where nearly power full enough to take out his boat, we are in the clear now mate. Then BOOM incoming fire shields down to half... I think to myself well hes out of the chase just one left, then BOOM incoming fire shields gone! But its the same ship how can that be I said to myself! them BOOM and a big flash of light and I wake up in my escape pod on Planet Malta. Chalk one for the good guys!

OORP question on the rules would cutting engines firing and reforming on a group member over and over to catch up, get around the MAX cruise speed cap be against or within the rules I'm not looking for a sanction just some clarification on the subject.
Using Engine kill from cruise speed to fire at fleeing people is, as far as I am aware, not a sanctionable offence. UNles sthe target itself is not in cruise, in which case using cruise to catch up is wrong.
On a related topic, and one that I think has been asked before (not sure where, though)...
Let's say I'm using Blackmoon, my Lane Hacker, and fleeing from some LSF agents. All of us are cruising along, and I'm clearly not getting any further away.
Is it legal to engine kill to drop some mines or CD my pursuers so I can get away? I'm pretty sure that would be allowed ("However, the fleeing player can re-engage at will if chased."), but I'd like to be absolutely certain before I try it.

If my understanding of the situation is correct he was not using the formation in order to just catch up.
He was using it to get within gun range otherwise he would never be able to do enough damage to actually kill the target unless this is another case of someone double stacking weapons.
