I agree, if we were to give player factions some extra right like this we'd need to prevent them from e.g. using it against their own indies. It'd still be very easy to abuse for reasons way beyond stopping smugglers.
And in general I'm not convinced at all about limiting such things to player factions.

Well that shouldn't be a problem, the list should just be checked and possibly updated every time a base is created or ownership changed.
